End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and In The Biz AI ("we," "our," or "us") for the use of the In The Biz AI mobile application and web service ("Service").

By downloading, installing, or using the Service, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the Service.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or business use, subject to the terms of this Agreement.

2. Permitted Use

You may use the Service to:

Track your income, tips, wages, and shifts
Scan and store receipts, paychecks, invoices, and business cards
Generate financial reports and export data
Sync shifts with your calendar
Connect to QuickBooks for accounting purposes
Use AI-powered features to extract data from documents

3. Restrictions

You agree NOT to:

Reverse engineer, decompile, or disassemble the Service
Remove or modify any copyright, trademark, or proprietary notices
Use the Service for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service or servers
Use the Service to transmit malware, viruses, or harmful code
Scrape, crawl, or use automated tools to extract data from the Service
Resell, redistribute, or sublicense the Service
Use the Service on behalf of third parties without authorization

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized access to your account
You must provide accurate and complete information when creating an account
You must be at least 13 years old to use the Service

5. Subscription and Payments

5.1 Free Version

The free version includes advertisements
Limited AI scans per month
Basic features available at no cost

5.2 Pro Subscription

Subscription fees are charged monthly or annually
Subscriptions automatically renew unless canceled
You can cancel your subscription at any time through your device's app store
Refunds are subject to the app store's refund policy (Apple App Store or Google Play Store)
Pro features include: ad-free experience, unlimited AI scans, advanced analytics, priority support

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by In The Biz AI
Our trademarks, logos, and service marks are protected by law
You retain ownership of the data you input into the Service
You grant us a license to use your data to provide and improve the Service

7. User Content

You retain ownership of all content you upload (receipts, photos, documents)
You grant us a license to store, process, and display your content to provide the Service
You are responsible for ensuring you have the right to upload any content
We reserve the right to remove content that violates this Agreement

8. AI and Data Processing

The Service uses AI (Google Gemini) to extract data from scanned documents
AI-extracted data may not be 100% accurate - you should review and verify all data
Scanned images are processed securely and not stored by third-party AI providers
We are not responsible for errors in AI-extracted data

9. Third-Party Integrations

The Service integrates with QuickBooks, Google Calendar, and other third-party services
Your use of third-party services is subject to their own terms and conditions
We are not responsible for the availability, accuracy, or functionality of third-party services
You authorize us to access third-party services on your behalf when you connect them

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that the Service will be uninterrupted, error-free, or secure
We do not warrant the accuracy, completeness, or reliability of any data or content
We do not provide financial, tax, or legal advice
You should consult with a qualified professional for financial and tax matters

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the Service in the past 12 months
We are not liable for data loss, financial losses, or tax issues arising from use of the Service
You use the Service at your own risk

12. Tax and Financial Disclaimer

The Service is a tool for tracking income and expenses
We do not provide tax advice or guarantee the accuracy of tax estimates
You are responsible for reporting your income accurately to tax authorities
You should consult with a tax professional or accountant for tax matters
We are not liable for any tax penalties, audits, or legal issues

13. Termination

You may terminate this Agreement by deleting your account and uninstalling the app
We may terminate or suspend your access to the Service at any time for violation of this Agreement
Upon termination, your data will be deleted in accordance with our Privacy Policy
Provisions that should survive termination (e.g., disclaimers, limitations of liability) will remain in effect

14. Updates and Changes

We may update the Service from time to time
Updates may add, modify, or remove features
We may modify this Agreement at any time by posting the updated version
Your continued use of the Service after changes constitutes acceptance of the new terms

15. Governing Law

This Agreement is governed by the laws of the United States
Any disputes shall be resolved in the courts of the United States
If any provision is found to be unenforceable, the remaining provisions will remain in effect

16. Indemnification

You agree to indemnify and hold harmless In The Biz AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the Service
Your violation of this Agreement
Your violation of any third-party rights
Your content or data uploaded to the Service

17. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and In The Biz AI regarding the Service.
